General terms and conditions

1. scope

The following terms and conditions apply to all orders placed via our online store. Our online store is aimed exclusively at consumers.
A consumer is any natural person who enters into a legal transaction for purposes that can predominantly be attributed neither to his commercial nor to his independent professional activity. An entrepreneur is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of his commercial or independent professional activity.

 

2. contracting party, conclusion of contract

The presentation of the products in the online store does not constitute a legally binding offer, but a non-binding online catalog. You can initially place our products in the shopping cart without obligation and correct your entries at any time before sending your binding order by using the correction tools provided and explained for this purpose in the order process. By clicking the order button you make a binding offer to purchase the goods contained in the shopping cart. The confirmation of receipt of your order will be sent by e-mail immediately after sending the order.

When the contract with us is concluded depends on the payment method you have chosen:

 

Credit card

We accept your order by sending a declaration of acceptance in a separate e-mail or by delivering the goods within one week.

 

PayPal

In the ordering process you will be redirected to the website of the online provider PayPal. There you can enter your payment details and confirm the payment instruction to PayPal. After placing the order in the store, we request PayPal to initiate the payment transaction and thereby accept your offer.

 

Prepayment

We will accept your order by sending a declaration of acceptance in a separate e-mail within two days, in which we will provide you with our bank details.

 

3. contract language, contract text storage

The language available for the conclusion of the contract is German.

We save the text of the contract and send you the order data and our terms and conditions by e-mail. The text of the contract is no longer accessible via the Internet for security reasons.

 

4. delivery conditions

In addition to the indicated product prices, we charge a flat shipping fee under an order value of 40 €, as indicated in the check-out.

We deliver only by shipping and (unless previously agreed) only within Europe. Unfortunately, self-collection of the goods is not possible.

5. payment

In our store you can basically use the following payment methods:

 

Credit card

When you place your order, you also provide us with your credit card details.
After your legitimation as a legitimate cardholder, we will request your credit card company to initiate the payment transaction immediately after the conclusion of the contract. The payment transaction is carried out automatically by the credit card company and your card is charged.

 

PayPal 

In the ordering process you will be redirected to the website of the online provider PayPal. In order to pay the invoice amount via PayPal, you must be registered there or register first, legitimize with your access data and confirm the payment instruction to us. After submitting the order in the store, we request PayPal to initiate the payment transaction. 
The payment transaction is carried out automatically by PayPal immediately afterwards. You will receive further instructions during the ordering process. 

 

Prepayment

If you choose payment in advance, we will give you our bank details in a separate e-mail and deliver the goods after receipt of payment.

 

6. retention of title

The goods remain our property until full payment.

 

7. transport damage

If goods are delivered with obvious transport damage, please complain about such defects to the delivery person as soon as possible and contact us immediately. Failure to make a complaint or contact us will have no consequences for your legal claims and their enforcement, in particular your warranty rights. However, they help us to be able to assert our own claims against the carrier or the transport insurance.

 

8. warranty and guarantees

The statutory liability for defects shall apply. Information on any additional warranties that may apply and their exact terms can be found with the product and on special information pages in the online store.

 

9. liability

For claims based on damages caused by us, our legal representatives or vicarious agents, we shall always be liable without limitation

  • in case of injury to life, body or health,
  • in the event of intentional or grossly negligent breach of duty,
  • in the case of warranty promises, if agreed, or
  • insofar as the scope of application of the Product Liability Act is opened.

In the event of a breach of material contractual obligations, the fulfillment of which is a prerequisite for the proper execution of the contract and compliance with which the contractual partner may regularly rely on (cardinal obligations) due to slight negligence on our part, on the part of our legal representatives or vicarious agents, the liability shall be limited to the amount of the damage foreseeable at the time of the conclusion of the contract, the occurrence of which must typically be expected. Otherwise, claims for damages are excluded.

 

10. dispute resolution

We are not obligated or willing to participate in dispute resolution proceedings before a consumer arbitration board.

 

Supplementary GTC for our campaigns/collections

1) In the form of collections/campaigns Matema KG offers the possibility to pre-order products. Matema KG as well as the customer shall be entitled to withdraw from the contract if the pre-ordered product is not delivered to the customer by Matema KG within three (3) months from confirmation of the pre-order. For Matema KG exists
this right of withdrawal only if they are not supplied with the relevant product within this period. In this case, Matema KG will inform the customer of this without delay and, if applicable, refund any consideration already paid. Apart from that, neither Matema KG nor the customer shall have the right,
to cancel a confirmed pre-order.

2) The Customer shall pay for the pre-ordered goods at the time of ordering. As a young start-up, Matema KG relies on this payment to finance production.

3) Matema KG shall not be liable for any damages incurred by the customer as a result of failure to comply with the expected availability or delivery period or time, if any, specified in the advance order. The points mentioned under point 9 of the GTC regarding liability remain unaffected by this and continue to apply.
